These Terms of Service ("Terms") govern your use of ecomluxx.com, StoreSignal (storesignal.app), and any related services we provide (together, the "Services"). The Services are operated by Ecom Luxx LLC ("Ecom Luxx," "we," "us," or "our"), a Wyoming limited liability company with its registered address at 30 N Gould St, Sheridan, WY 82801, USA.

By using the Services, you agree to these Terms. If you don't agree, please don't use them.

1. What we do

Ecom Luxx provides conversion rate optimisation (CRO), e-commerce strategy, design, and development services for Shopify and other direct-to-consumer brands. Our offerings include:

  • CRO audits and consulting
  • Conversion-focused design and development
  • GrowthOps™ retainer engagements
  • Free tools, including the StoreSignal audit generator

Engagements for paid services are governed by separate written agreements between Ecom Luxx and the client. These Terms apply to your use of our website and free tools, and they supplement (do not replace) any signed services agreement.

2. No purchase happens on this website

The website does not process sales transactions. All paid engagements begin with a discovery call (scheduled via Calendly) and proceed through a separate signed services agreement and invoice. Pricing shown on the website is indicative only and may change.

3. Eligibility

You must be at least 18 years old and have the authority to enter into agreements on behalf of yourself or any business you represent in order to use the Services.

4. Acceptable use

You agree to use the Services lawfully and not to:

  • Use the Services to violate any law or regulation.
  • Attempt to gain unauthorised access to any part of the Services.
  • Interfere with or disrupt the Services.
  • Use automated tools to scrape or harvest data from the Services beyond standard search engine indexing.
  • Use the Services to harass, harm, or impersonate any person.
  • Submit false, misleading, or fraudulent information through any form on the website, including booking forms and StoreSignal.

We reserve the right to suspend or restrict access for anyone who violates these terms.

5. StoreSignal and AI-generated content

StoreSignal generates audits using artificial intelligence based on publicly available information about your Shopify store. These audits are provided as general informational guidance only.

You acknowledge that:

  • AI-generated content may contain errors, inaccuracies, or outdated information.
  • StoreSignal output is not a substitute for a paid audit conducted by our team.
  • We do not guarantee that following StoreSignal recommendations will produce any specific result.
  • Where StoreSignal is unable to scan your store, we provide an honest message explaining the limitation rather than generic guidance.

6. Results, claims, and disclaimers

We share case studies, statistics, and outcome examples on our website (for example, conversion rate uplifts, revenue increases, and other performance figures). These reflect specific results achieved with specific clients in specific circumstances.

Past results do not guarantee future results. Your outcomes will depend on your business, your traffic, your offer, your operational execution, market conditions, and many factors outside our control. We do not promise or guarantee any specific revenue increase, conversion rate uplift, traffic level, or business outcome from working with us or from using our free tools.

All Services and content on the website are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. To the maximum extent permitted by law, we disclaim all such warranties.

7. Intellectual property

All content on ecomluxx.com and within our tools, including text, graphics, logos, code, designs, frameworks, methodologies (such as the GrowthOps™ system), and trademarks, is owned by Ecom Luxx or our licensors and is protected by applicable intellectual property laws.

You may view and download materials for personal, non-commercial review of our services. You may not copy, reproduce, republish, distribute, modify, or create derivative works of our content without our prior written permission.

If you submit feedback, suggestions, or ideas to us, you grant us a non-exclusive, perpetual, royalty-free licence to use them without obligation.

8. Third-party links and services

Our website links to third-party platforms (including Calendly, Clutch, Trustpilot, social media, and others). We are not responsible for the content, policies, or practices of those third parties. Your use of any third-party service is governed by that service's own terms and privacy policy.

9. Privacy

Our handling of personal information is described in our Privacy Policy. By using the Services, you agree to that policy.

10. Limitation of liability

To the maximum extent permitted by law, Ecom Luxx and its officers, members, employees, contractors, and affiliates shall not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Services or the website, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or related to these Terms or the Services is limited to the greater of:

  • One hundred US dollars (US$100), or
  • The amount you paid to us in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law (such as liability for fraud or gross negligence).

11. Indemnification

You agree to defend, indemnify, and hold harmless Ecom Luxx and its officers, members, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Services;
  • Your breach of these Terms;
  • Your violation of any law or third-party right; or
  • Any content or information you submit through the Services.

12. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Colorado, and you and we consent to the personal jurisdiction of those courts.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

13. Changes to these Terms

We may update these Terms from time to time. The most current version will always be posted at ecomluxx.com/terms with an updated "Last updated" date. Continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms.

15. Entire agreement

These Terms, together with our Privacy Policy and any separate written services agreement, constitute the entire agreement between you and Ecom Luxx regarding your use of the Services.
