These Terms of Service ("Terms") govern your use of ecomluxx.com, StoreSignal and our other free tools (together, the "Services"), operated by Ecom Luxx LLC ("Ecom Luxx", "we", "us"), a Wyoming limited liability company. By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. What we do

Ecom Luxx provides conversion rate optimisation (CRO) audits and consulting, conversion-focused design and development for Shopify brands, GrowthOps™ retainer engagements, and free tools including StoreSignal.

2. No purchases on this website

The website does not process sales transactions. Paid engagements are arranged through discovery calls and governed by separate written agreements and invoices. Nothing on the website constitutes a binding offer of services at a particular price.

3. Eligibility

You must be at least 18 years old to use the Services, and you represent that you have the authority to act for yourself or the business you represent.

4. Acceptable use

You agree not to:

  • use the Services for any unlawful purpose or in violation of any applicable law;
  • attempt to gain unauthorised access to the Services, other users' data, or our systems;
  • interfere with or disrupt the operation of the Services;
  • scrape, harvest or extract data from the Services other than ordinary search-engine indexing;
  • harass, abuse or impersonate any person or entity; or
  • submit false, misleading or fraudulent information.

5. StoreSignal and AI-generated content

StoreSignal generates automated audits using artificial intelligence based on publicly available information about Shopify stores. AI-generated content may contain errors, inaccuracies or outdated information, and is provided for general informational purposes only. It does not constitute professional advice, and we do not guarantee that acting on it will produce any particular result.

6. Results, claims and disclaimers

Any results, case studies or figures referenced on the website reflect specific past engagements. Past results do not guarantee future results. The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

7. Intellectual property

All content on the Services — including text, designs, graphics, frameworks, methodologies and tools — is owned by Ecom Luxx or its licensors and is protected by intellectual property laws. You may view and use materials for your personal or internal business review only. You may not copy, reproduce, distribute or create derivative works from our content without our prior written permission.

8. Third-party links and services

The Services link to or embed third-party platforms — including Calendly (scheduling), Clutch, Trustpilot and social media platforms. We are not responsible for the content, terms or privacy practices of third-party services, and your use of them is at your own risk and subject to their terms.

9. Privacy, cookies and visitor identification

Our Privacy Policy explains how we handle personal information, and our Cookie Policy explains the cookies and similar technologies we use — including analytics, session replay (Microsoft Clarity) and visitor-identification technology (RB2B) that may associate your visit with business contact information. Both policies are incorporated into these Terms by reference. Opt-out mechanisms are described in those policies.

10. Limitation of liability

To the maximum extent permitted by law, Ecom Luxx will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from or related to your use of the Services. Our total aggregate liability arising out of or relating to the Services will not exceed the greater of (a) US $100 or (b) the amounts you paid us for services in the twelve months before the claim arose.

11. Indemnification

You agree to defend, indemnify and hold harmless Ecom Luxx and its officers, members, employees and agents from any claims, damages and expenses (including reasonable legal fees) arising from your use of the Services, your breach of these Terms, your violation of any law or third-party right, or any content you submit.

12. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. The state and federal courts located in Colorado will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to personal jurisdiction and venue there.

13. Changes to these Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date, and your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including breach of these Terms. Sections that by their nature should survive termination (including sections 6, 7, 10, 11 and 12) will survive.

15. Entire agreement

These Terms, together with the Privacy Policy, the Cookie Policy and any separate written services agreement between you and Ecom Luxx, constitute the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions remain in full effect.
